Terms of Service

These terms govern your use of Klosa for sending money, paying bills, and managing family payments. Please read them carefully before you use the Services.

Overview & acceptance

These Terms of Service (“Terms”) govern your access to and use of the Klosa mobile app, our website at klosa.app, and related services (together, the “Services”), operated by Klosa Technologies Inc. (“Klosa”, “we”, “us”, or “our”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Plain-language summary

Klosa lets you send money to Ghana, pay bills, and manage payments for family. To use it you must be eligible, verify your identity, and use the Services lawfully. Fees and exchange rates are shown before you confirm, and we may pause or refuse transactions to meet our legal obligations.

Eligibility

You must be at least the age of majority in your province, territory, or country of residence and legally able to enter into a binding contract. You agree to provide accurate, current, and complete information when you register and to keep it up to date. The Services are available only in the regions we support, and certain features depend on your country of residence and destination corridor.

Your account & security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We secure access using your password, one-time verification codes sent by SMS or email, and, if you enable it, device biometrics. You agree to receive verification codes as described in our Privacy Policy. Notify us immediately at support@klosa.app if you suspect unauthorized use of your account.

The Services

Klosa currently enables eligible users to:

  • Send money from Canada to recipients in Ghana, with payout to mobile-money wallets or bank accounts;
  • Pay bills such as electricity, TV, school fees, water, and airtime on behalf of recipients;
  • Manage family payments by saving family members and their payout and service details; and
  • Split a transfer across contributors where that feature is available.

Availability of specific features, corridors, payout methods, and billers may vary and may change over time. Transactions are subject to verification, review, and the terms of our payment and payout partners.

Identity verification & compliance

Klosa operates as a regulated money-services business. Before you can transact, and from time to time afterward, we are legally required to verify your identity and may collect government-issued identification, a selfie, and other information. We screen transactions against sanctions and other legal requirements. We may refuse, delay, suspend, reverse, or report a transaction, and suspend or close an account, where necessary to comply with the law or to prevent suspected fraud, money laundering, or misuse.

Fees & exchange rates

The fee and the exchange rate that apply to a transaction are displayed before you confirm it. By confirming, you authorize Klosa to process the transaction at the disclosed amounts. Exchange rates fluctuate, and a quoted rate may be valid only for a limited time; if a quote expires, you may be shown an updated rate before you can proceed.

Funding & payments

You fund transactions using the payment methods we support, which may include cards, Apple Pay, Google Pay, and bank transfers, processed through our payment partners. Card and wallet details are handled directly by those processors and are not stored by Klosa. You represent that you are authorized to use the payment method you provide. We may decline or reverse a payment that fails authorization, is suspected to be fraudulent, or is charged back.

Payouts & delivery to recipients

We deliver funds and bill payments through our payout partners in Ghana. You are responsible for the accuracy of the recipient and payout details you enter (such as mobile-money numbers, bank account numbers, and bill account or meter references). Payments made to details you provide incorrectly may not be recoverable. Delivery times are estimates and may be affected by our partners, recipient banks or mobile-money operators, and required compliance checks.

Beneficiaries & family members' information

When you add a beneficiary or family member, or share a self-fill link so they can enter their own details, you provide us with the personal information of other people. You represent and warrant that you have the authority and consent to share their information with us for the purpose of sending money, paying bills, and providing the Services, and that the information is accurate.

Acceptable use

You agree that you will not use the Services to:

  • Break any applicable law or regulation;
  • Facilitate money laundering, terrorist financing, fraud, or sanctions evasion;
  • Transact on behalf of an undisclosed third party;
  • Provide false, misleading, or incomplete information; or
  • Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Services.

Communications consent

You consent to receive transactional and service-related communications from us, including verification codes, transaction updates, and account and security notices, by SMS, email, and in-app or push notifications. Message and data rates may apply. Details about our text-messaging practices, including how to get help or opt out, are in our Privacy Policy.

Intellectual property

The Services, including their content, design, software, and trademarks, are owned by Klosa or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for their intended personal, non-commercial purpose. You may not copy, modify, distribute, or create derivative works from any part of the Services except as permitted by these Terms.

Third-party services

The Services rely on third-party providers, including payment processors, payout partners, messaging providers, and mapping/address services. Your use of features that depend on them may also be subject to their terms, and we are not responsible for the acts or omissions of third parties.

Disclaimers & limitation of liability

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

To the maximum extent permitted by applicable law, Klosa and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory consumer- protection rights.

Indemnification

You agree to indemnify and hold harmless Klosa and its directors, employees, and partners from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

Governing law & disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Subject to any mandatory consumer-protection rights available to you, you agree to the exclusive jurisdiction of the courts located in Ontario, Canada, for any dispute arising from these Terms or the Services.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
